  • Arbitration Rules: The arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or Commercial Arbitration Rules if Consumer Rules are deemed not to apply) then in effect (the "AAA Rules"), except as modified by these Terms. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879.

  • Arbitration Location: The arbitration shall take place in Collin County, Texas, unless another location is mutually agreed upon.

  • Arbitrator: The arbitration will be conducted by a single arbitrator, experienced in internet law and commercial disputes, selected in accordance with the AAA Rules.

  • Arbitration Process: A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules.

  • Arbitrator's Decision: The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator's decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator's award of damages must be consistent with the terms of the "Limitation of Liability" section above as to the types and amounts of damages for which a party may be held liable.

  • Fees: Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules.

  • Class Action Waiver: YOU AND PKC LEGAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, if the parties’ dispute is resolved through arbitration, the arbitrator may not consolidate another person's claims with your claims and may not otherwise preside over any form of a representative or class proceeding.
